Gift Terms

These terms apply to digital gifts issued by Lispa Group Ltd. (“Lispa”, “we”, “us”).
They are designed to make purchasing, giving and redeeming a Lispa gift clear and predictable while preserving all rights that apply under consumer law.
Purchase and delivery
A gift purchase is confirmed when payment has been successfully accepted and Lispa issues the applicable confirmation.
The purchaser is responsible for checking the recipient name, email address, selected gift and requested delivery date before completing the purchase.
For gifts scheduled for future delivery, Lispa will use the delivery information supplied by the purchaser.
Please contact Lispa promptly if any recipient or delivery information needs to be corrected. We will make reasonable efforts to amend information before delivery but cannot guarantee changes once a gift has already been sent.
Validity
Unless a different period is clearly stated before purchase, Lispa gifts are valid for six months from the date on which they are delivered to the recipient.
For gifts scheduled in advance, the validity period begins on the scheduled delivery date rather than the purchase date.
The applicable expiry date will appear on the digital gift or voucher status page.
The validity terms disclosed when a purchased gift is issued will not be retrospectively reduced.
Treatment gifts
A treatment gift may be redeemed for the treatment and duration stated on the gift, subject to appointment availability and treatment suitability.
Where a treatment gift remains valid but the named treatment has been permanently discontinued or can no longer reasonably be supplied by Lispa, Lispa will preserve the value paid by offering a reasonable equivalent treatment or credit toward another available treatment.
A treatment gift that identifies a specific treatment remains redeemable for that treatment during its validity period notwithstanding an ordinary subsequent price increase, unless the gift expressly states that it represents a monetary value rather than the treatment itself.
If the recipient chooses a different or higher-value treatment, any additional amount must be paid at the time required by Lispa.
Monetary gifts
A monetary gift may be used toward eligible Lispa treatments or services.
Unless otherwise stated when purchased, a monetary gift may be used over more than one visit.
Any unused balance remains attached to the original voucher code until it is redeemed or the gift expires.
No cash change is given for an unused voucher balance.
Voucher security
Voucher and QR codes should be treated as confidential.
Please contact Lispa promptly if a code is lost, sent to the wrong person or believed to have been accessed without permission.
Where Lispa can reasonably verify the original purchase, we may invalidate an unused code and issue a replacement.
Lispa may refuse or temporarily suspend redemption of a voucher where there are reasonable grounds to believe that the code is invalid, duplicated, cancelled, refunded, fraudulently obtained or being used without authority.
Lispa is not responsible for unauthorised use resulting from a voucher code being voluntarily shared or inadequately protected by the purchaser or recipient, except where the loss results from Lispa’s own act, omission or security failure or where liability cannot lawfully be excluded.
Cash exchange and transfer
Lispa gifts are not redeemable for cash except where required by law.
Complimentary or promotional gifts have no cash value and are not refundable unless applicable law requires otherwise.
Where recipient details need to be changed before redemption, please contact Lispa. Lispa may require reasonable verification of the purchaser or voucher before making the change.
Cancellations, refunds and statutory withdrawal rights
Nothing in these Gift Terms limits any statutory cancellation, withdrawal, refund or other consumer right.
Where the law gives a purchaser a right to withdraw from a distance purchase, the purchaser may exercise that right within the applicable statutory period, ordinarily 14 days from the relevant date under applicable law, without giving a reason. To submit a withdrawal request online, use the withdrawal request form or email [email protected] with the purchase reference, voucher code where available and a clear statement of the decision to withdraw.
Where a valid withdrawal right is exercised, Lispa will process any refund due within the applicable statutory period. A right of withdrawal may be excluded or affected in particular circumstances under applicable law, including where a gift has already been redeemed or where the consumer has expressly requested immediate performance and acknowledged the consequences for the withdrawal right.
Whether a particular refund or cancellation request can be accepted may depend on the applicable statutory rights, payment status and whether the gift has already been redeemed, refunded or otherwise used.
Once a voucher has been validly refunded, cancelled or reversed, its code becomes invalid and cannot subsequently be redeemed.
A redeemed amount cannot also be refunded except where required by applicable law.
Refunds due from Lispa will normally be made to the original payment method unless another method is expressly agreed or required by law.
Expiry
A gift should be redeemed before the expiry date shown on it.
Subject to any mandatory legal right, any unused value remaining after expiry ceases to be redeemable.
Lispa may choose to extend a voucher as a gesture of goodwill, but doing so in one case does not create an obligation to extend another voucher.
Appointments
A Lispa gift does not guarantee a particular appointment date, practitioner, venue or time.
Appointments remain subject to availability, treatment suitability and the Lispa Booking Policy.
Where an appointment has been made using a gift, the cancellation and late-arrival conditions disclosed for that appointment also apply.
Fraud, misuse and technical errors
Lispa may cancel, suspend or investigate a voucher where there is reasonable evidence of fraud, unauthorised duplication, payment reversal, technical manipulation or misuse.
Where a voucher has been created or credited because of an obvious technical or administrative error, Lispa may correct that error, provided that this does not remove value legitimately purchased by the customer or affect a right protected by law.
Changes to these terms
Lispa may update these Gift Terms for future purchases.
A material change will not retrospectively reduce the value or validity of a gift that has already been purchased, unless the change is required by law or is more favourable to the holder.
Consumer rights and governing law
Nothing in these terms excludes or restricts any right or remedy that cannot lawfully be excluded or restricted.
These terms are governed by Maltese law, without depriving a consumer of any mandatory protection applicable to them under law.
If a dispute cannot be resolved directly with Lispa, consumers may have access to the Malta Competition and Consumer Affairs Authority and applicable alternative dispute resolution procedures.
